This policy is updated and effective as of: April 28, 2026.

MapHabit, Inc., together with its parents, subsidiaries and affiliates (“MapHabit”, “we”, “us” or “our”), is committed to protecting your (“your”, “your” or “user”) privacy and empowering you with this privacy policy (this “Privacy Policy”). This Privacy Policy explains how we collect, use, disclose, and apply the information collected when you access or use our products and/or services, including our website (https://maphabit.com) (the “Website”), software, including our mobile application (the “Software”), and such integrated services and features (collectively, the “Services”). Our Terms of Service, located on our website (the “Terms”) are expressly incorporated herein, by, reference, and are an integral part hereof. All capitalized terms used but not defined herein shall have the meanings set forth in the Terms.

 

            This Privacy Policy sets forth our policy with respect to information that we collect from you, on or through the Services, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Data”, or “Personal Information”). We take the privacy of your Personal Data seriously. Because of that, we have created and abide by this Privacy Policy. By using the Services or interacting with us, you are agreeing to the application of this Privacy Policy. Please read the following carefully to understand how we collect, use, disclose, and maintain information that can be used to identify you. In addition, this Privacy Policy describes your choices for use, access, and correction of your Personal Data. If you do not agree to be bound by this Privacy Policy, please stop accessing or using the Services.

 

1.         Changes to this Privacy Policy. We may change this Privacy Policy, at any time and from time to time. In the event that we make changes, we will notify you by revising the “Last Updated” date at the top of this Privacy Policy. If there are significant changes to this Privacy Policy, we will attempt to notify you directly by e-mail, or provide information via our Services homepage prior to any such changes becoming effective. We encourage you to review our Privacy Policy whenever you use the Services to stay informed of ways that you can protect your privacy.

 

2.         Information We Collect and Receive. You may choose to submit information to us when you use our Services, create an account via the Services, if applicable, or when interacting with us. More information about the categories and sources of Personal Data is provided below. 

 

            2.1       Information You Provided to Us. We collect Personal Data that you decide to share with us. At times, we may require you to provide certain information in order to use certain parts of our Services, fulfill your requests, or provide you with certain services.

 

                        2.1.1    Account Information. If you establish an account with us, or purchase a Subscription Plan, or otherwise purchase or receive Services from us, we may require you to provide your name, e-mail address, phone number, payment information, and a password. All payment data is processed by Stripe, Inc., our third-party payment processor, and you should review their privacy policy carefully. We may change processors, from time to time, and, if we do, we will attempt to notify you of the same, to give you an opportunity to review any associated privacy policy.

 

                        2.1.2    User Submissions. We collect and store User Submissions that you upload, post, send, receive and share through the Services.

 

                        2.1.3    Welcome Review Meeting. In order to best provide our Services, we may require or request a “welcome review” meeting with you, whereby you may choose to share certain information about yourself and the Patient, including, but not limited to, information which may be considered protected health information (“PHI”).

 

                        2.1.4    Contacting Us. If you contact us by e-mail, telephone or any other means to report a problem with our Services, or you request information from us, we may record your Personal Data, as well as the content of your communication to help us respond to your inquiry and for future training purposes. You may also choose to submit information to us via other methods, including:  (i) in response to marketing or other communications, (ii) through social media or online forums, or (iii) in connection with an actual or potential business relationship with us.

 

                        2.1.5    Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include Personal Data.

 

2.2       Information We Obtain from Others. We may obtain Personal Data about you from third-parties who help us provide our Services. We may also obtain some information from our marketing partners in order to inform you about products or services that we think you might be interested in. Finally, we may obtain information that does not identify you directly, but which is later used in a way that may directly identify you. We may combine that general information with your Personal Data to provide related services to you.

 

2.3       Information We Automatically Collect. We automatically collect certain information from you when you use the Services, including internet or other network activity information (as described below), unique device identifiers, browsing and search history (including content you have viewed in the Services), and cookies and other technologies (as described below). Information collected automatically includes:

 

            2.3.1    Log information. We retain information about you when you access and use the Services. This information can include, e.g., the following:  Internet Protocol (“IP”) address, timestamps, device ID, browser information, Internet Service Provider, webpages visited, and the URL of the webpage you visited before navigating to our Services.

 

            2.3.2    Usage Information. We monitor user activity in connection with the Services and may collect information about the applications and features you use, websites you visit, as well as types and amount of the Services you use.

 

            2.3.3    Crash and Error Information. If the Services crash or return an error, we may collect data to determine the cause of the error using first or third-party services. The crash or error information collected may include, e.g., the following:  device IP address, device name, operating system version, application configurations(s), the time and date, and other statistics.

 

            2.3.4    Location information. When using the Services, we may collect and process certain location-based information, including geolocation data, from your mobile device or web browser.

 

3.         Cookies and Other Technologies. Our Services may use cookies and other technologies (such as “pixel tags”, “web beacons”, “clear GIFs”, tracking scripts, links in e-mails, JavaScript, device IDs assigned by Google or Apple, or similar technologies) to collect information and support certain features of our Services. Cookies and other technologies allow us and third-parties to obtain information about your visits to our website and use of our Services, including analyzing your visiting patterns, as well as your visits to and use of other websites and services. For example, we use Google Analytics to collect information to improve the Services, such as how often users visit a website, what pages they visit when they do so, and what other website they used prior to visiting the Services. Google Analytics places a cookie on your web browser so that it can identify you the next time you visit the Site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our website and use of our Services is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Although you are not required to accept cookies when you visit our Services, you may be unable to use all of the functionality of our Services if your browser restricts our cookies. We use this information to process your requests and to deliver online and mobile advertisements, messages, and content for us and others that are specific to your interests. The information we collect from cookies and other technologies does not identify you personally but in some cases, we may link it to your Personal Data, including, but not limited to your IP address used to access our website as well as your geolocation.

 

3.1       Cookies. Below, we explain the different types of cookies that may be used on the Services.

 

            3.1.1    Necessary Cookies. Necessary cookies are essential to enable your use of the Services and to identify and prevent security risks, such as storing your session information to prevent others from changing your password without your username and password.

 

            3.1.2    Preference Cookies. We use these cookies to remember your settings and preferences and to improve your experience on our website and in using our Services. For example, we may use these cookies to remember your language preferences.

 

            3.1.3    Session Cookies. Session cookies are stored only temporarily during a browsing session and are deleted from your device when you close the browser. We use these cookies to support the functionality of the Services and to understand your use of the Services—that is, which pages you visit, which links you use, and how long you stay on each page.

 

            3.1.4    Statistics Cookies. Statistics cookies help collect information about your use of the Services and enable us to improve the way it works. These cookies give us aggregated information that we use to monitor the Services’ performance, count page visits, spot technical errors, see how users reach the Services, and measure the effectiveness of marketing (including e-mails).

 

            3.1.5    Marketing/Advertising/Targeting Cookies. If employed by us, from time to time, marketing cookies are used to show users display advertisements across websites. The intention is to display ads that are relevant and engaging for the individual user and thereby more valuable for publishers and third-party advertisers. We do not display ads for any website besides our own. Additionally, we may use, and allow third party advertising companies that we work with, including, but not limited to, GetEmails, LLC d/b/a R! B2B, to utilize, a combination of first and third party cookies to obtain information about your visits to our Website and your visits to and use of other websites and services, as well as tracking scripts, your device ID and IP address, to better identify/associate you so that we may then send you certain marketing and advertising communications regarding our Services. You may opt out of receiving the foregoing marketing and advertising communications from us by visiting https://app.retention.com/optout”, or by selecting the “opt-out” or “unsubscribe” link contained in any such marketing and advertising communications sent by us.

 

            3.1.6    Unclassified Cookies. Unclassified cookies are cookies that we are in the process of classifying, together with the providers of individual cookies.

 

3.2       Other Technologies. In addition to cookies, we may use other technologies to, among other things, track the actions of users of the Services (about usage including e-mail recipients), measure the success of our marketing campaigns, and compile statistics of the Services and response rates.

 

4.         How We Use Your Information.

 

4.1    For Our Legitimate Business Interests. We may use the Personal Data that we collect for our legitimate interests and the limited purpose of providing the Services and as permitted by applicable law. These purposes include circumstances where it is necessary to provide or fulfill the Services requested by or for you or where you have given us your express consent. As such, we may use your Personal Data to:

 

(i)        Provide the information, products, and services you request;

 

(ii)       Service your account and provide you, if you are a registered user, with effective customer service;

 

(iii)      Better understand your needs and interests, and provide you with a personalized experience when you use our Services;

 

(iv)       Improve our Services’ artificial intelligence (“AI”) tools, including its output, responses, and overall functioning;

 

(v)        Contact you with special offers and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us);

 

(vi)       Contact you with information that you have requested and notices related to your use of our Services;

 

(vii)      Send you commercial or marketing/advertising messages, including, without limitation, newsletters and e-mail communications about our offerings or Services;

 

(viii)     Invite you to participate in surveys and provide feedback to us (in accordance with any privacy preferences you have expressed to us);

 

(ix)       Improve our products and services, develop new products and services, improve our marketing and promotional efforts, and improve the content, functionality, and usability of the Services;

 

(x)        Enforce our other policies, such as our Terms;

 

(xi)       Promote security and protect against and prevent fraud, claims, and other liabilities;

 

(xii)      Verify the information that you provide to us as well as the representations and warranties that you make to us in the Terms or on the Services;

 

(xiii)     Meet our internal and external audit obligations; and

 

(xiv)     To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third-parties.

 

            4.2       With Your Consent. In some cases, we will ask you for consent to use your Personal Data for specific purposes. If we do, we will make sure that you can revoke your consent in accordance with the Section below entitled “Your Choices”.

 

            4.3       Other Purposes. If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to, or at the time that, the Personal Data is collected, or we will obtain your consent subsequent to such collection, but prior to such use.

 

            4.4       AI Tools. We may use AI–enabled tools and technologies to support internal business operations, including improving efficiency, providing and enhancing the Services, conducting data analysis, and assisting with customer support and administrative functions. These tools may process information, including Personal Data, provided to or generated by us in accordance with this Privacy Policy and applicable data protection laws. We do not use AI tools to make decisions that produce legal or similarly significant effects on individuals without appropriate human review, where required by applicable law. We take reasonable measures to evaluate AI vendors and to implement safeguards designed to protect Personal Data processed through AI tools. We do not use AI tools to train public or third-party AI models using Personal Data unless expressly disclosed or permitted by law.

 

4.5       Aggregated Personal Data. We may aggregate and/or de-identify information collected through the Services and from other sources so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including, without limitation, for research and marketing purposes.

 

5.         How We Share and Disclose Information.

 

            5.1       We Do Not Sell Personal Data. We do not sell or otherwise disclose Personal Data we collect about you, except as described herein or otherwise disclosed to you at the time the data is collected.

 

            5.2       Service Providers. We provide access to or share your Personal Data with select third-parties who perform services on our behalf. Pursuant to our instructions, these third-parties will access, process, or store Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure our service providers adhere to the security standards we apply to your Personal Data. Our service providers provide a variety of services to us, including, for example, billing, sales, marketing, product content and features, advertising, analytics, research, customer service, data storage, security, fraud prevention, payment processing, and legal services. Additionally, we may share your Personal Data with our service providers for their own advertising and marketing purposes, and you hereby provide your consent to the sharing of your Personal Data for the foregoing purpose.

 

            5.3       Your Consent. We may ask for your consent to share your Personal Data with third-parties. When we do, we will make it clear why we want to share the information. We may share your information for other purposes pursuant to your consent or with your further direction.

 

            5.4       Settings. We may share information consistent with your settings selections within the Website.

 

            5.5       Aggregate/De-Identified Data. From time to time, we may share Aggregate/De-Identified Information about use of the Services, such as by publishing a report on usage trends. The sharing of such data is unrestricted.

 

5.6       Legal Reasons. We may also disclose your Personal Data when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose your Personal Data, e.g., to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of our Services; to enforce or apply our policies or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We will attempt to notify our users about legal demands for their Personal Data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority.

 

5.7       Sale, Merger, or Other Business Transfer. As we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions (including in contemplation of such transactions), Personal Data may be among the transferred assets. If a portion or all of our assets are sold or transferred to a third-party, your Personal Data would likely be one of the transferred business assets. If such transfer is subject to additional mandatory restrictions under applicable laws, we will comply with such restrictions.

 

6.         Your Choices.

 

            (a)        You can manage cookies through your web browser. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. You can find out how to do this for your particular browser by clicking “help” on your browser’s menu or by visiting www.allaboutcookies.org. Please note, however, that without cookies you may not be able to take full advantage of all our website features. In addition to the browser-based controls, you can manage third-party cookies by visiting www.aboutads.info/choices/. Alternatively, for some devices, you may use your device’s platform controls in your settings to exercise choice. Please note you must separately opt-out in each browser and on each device. Advertisements on third-party websites that contain the AdChoices link may have been directed to you based on information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt-out of the advertising partners’ use of this information for interest-based advertising purposes.

 

(b)        You have a choice, at any time, to stop us from sending you e-mails for marketing purposes by following the “unsubscribe” link included in these messages. Please note that despite any indicated e-mail marketing preferences, we may continue to send you administrative e-mails regarding MapHabit, including, for example, notices of updates to our policies or this Privacy Policy if we choose to provide such notices to you in this manner.

 

            (c)        If you do not provide the information that we need to provide the Services, we may not be able to provide with the Services or certain functionalities. We will tell you what Personal Data that you must provide in order to use the Services and related functionalities or services. Do not provide the AI tools hosted on our Services with any Personal Data or sensitive data. MapHabit shall have no obligation to safeguard or protect, and no liability arising from, any Personal Data or sensitive data which you elect to provide to the AI tools.

 

 

(d)        Some browsers offer a “do not track” (“DNT”) option. Since no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make reasonable efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.

 

7.         Additional Information for Residents of Certain US States. If you are a U.S. resident, we process your Personal Data in accordance with applicable U.S. state data privacy laws. Depending on where you live (including California, Colorado, Connecticut, Oregon, Nevada, Utah, Virginia, etc.), you may be entitled to certain rights with respect to your Personal Data, as further described in Exhibit A. 8.           Information Retention. We keep your information for no longer than is necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and/or as required to comply with applicable laws.

 

9.         Data Processing and Data Transfers. In connection with your use of the Services, we may store, process, and transmit data in the United States of America and locations around the World—including those outside your country of residence. Your Personal Data, therefore, may be subject to privacy laws that are different from those in your country of residence. In such instances, we shall ensure that the transfer of your Personal Data is carried out in accordance with applicable privacy laws and, in particular, that industry appropriate contractual, technical, and organizational measures are in place.

 

10.       Security. We take reasonable precautions intended to help protect your Personal Data that we collect. Unfortunately, no system or online transmission of data is completely secure, and we cannot guarantee the security of data transmitted across the Internet. If you believe that information you provided to us is no longer secure, please notify us immediately using the contact information provided below.

 

11.       Links to Third-Party Websites. The Services may include links to third-party websites and services that we do not own or operate. When you click these links, you will be directed away from the Services to that third-party’s website. Any information you submit on that third-party’s website will be subject to that third-party’s practices and privacy policy. We encourage you to read these third-party privacy policies carefully before submitting your information.

 

12.       Children’s Privacy. The Services are directed to individuals over the age of eighteen (18). We do not knowingly collect Personal Data from individuals under the age of eighteen (18) (“Children”). If we become aware of any Children who have provided us with Personal Data, we will take steps to delete their Personal Data. If you become aware of information from Children, which has been provided to us, please contact us in accordance with the Section below entitled “Contact Us”.
